These Terms of Service (“Terms”) govern your access to and use of the Respawn Fitness mobile application, website, and related services (collectively, the “Services”) provided by Respawn Fitness LLC (“Respawn,” “we,” “us,” or “our”). By creating an account or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
You must be at least 16 years old to use the Services. By using Respawn, you represent and warrant that you meet this requirement and that the information you provide during registration is accurate and complete. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Respawn provides fitness programming, nutrition guidance, and recovery information for general informational purposes. We are not a medical provider, and the Services are not a substitute for professional medical advice, diagnosis, or treatment.
You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. You agree not to share your account, misuse the Services, attempt to reverse engineer the application, or use the Services for any unlawful purpose.
Certain features require a paid subscription. Fees, billing cycles, and renewal terms are disclosed at the point of purchase. Subscriptions renew automatically unless cancelled before the end of the current billing period. Except where required by law, payments are non-refundable. You may manage or cancel your subscription through your app store account settings.
All content, programming, trademarks, logos, and software that make up the Services are owned by Respawn or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for your personal, non-commercial use. You may not reproduce, distribute, or create derivative works without our written permission.
You retain ownership of content you submit, such as workout logs, progress photos, and community posts. By submitting content, you grant Respawn a worldwide, royalty-free license to host, display, and use that content solely to operate and improve the Services. You are responsible for ensuring your content does not violate the rights of others or any applicable law.
You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Services. Upon termination, your right to use the Services ends immediately, though certain provisions — including those relating to intellectual property, disclaimers, and limitation of liability — will survive.
To the fullest extent permitted by law, Respawn shall not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of — or inability to use — the Services. The Services are provided “as is” and “as available” without warranties of any kind.
We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date above and, where appropriate, notify you within the app. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
